ABOUT THE USER

A User is considered to be the person who accesses, browses or uses the services available on the website www.2cookinn.com, whether for information purposes or to purchase products.

The User undertakes to use the website only to make legally valid inquiries and orders, expressly authorizing 2Cookinn to cancel any false or fraudulent purchases, as well as to suspend or cancel a User’s access account, if acts are detected , fraudulent data or information when using the service.

The User will not be able to place their order without providing all the information required for this purpose. Such information will be, to the extent applicable, subject to the Privacy Policy of Abecedário Notavel Unip Lda, the entity responsible for 2Cookinn.

The images used to communicate products, on www.2cookinn.com and other digital channels, are merely illustrative, and there may be a difference between the colors of the image and those of the product. CONSTITUTION OF THE CONTRACT

The information contained in these conditions and on www.2cookinn.com does not constitute an offer to sell, but rather an invitation to contract. No purchase contract is considered to exist until there is, by Abecedário, express acceptance of the order placed by the User.

 

PRICES AND CAMPAIGNS

The price of each product may vary depending on the ongoing campaigns and their duration.

In this sense, the price of the product is what appears on the domain www.2cookinn.com on the date the order was placed, except in the case of an obvious error.

The price presented as the price of the product already includes VAT (Value Added Tax), that is, it is presented in RRP mode (Public Sale Price) and does not include costs for transporting the order, or others.

The prices shown are valid for the online store.

 

PLACING ORDERS

User Registration

Placing orders on the 2cookinn website depends on the User’s prior registration at www.2cookinn.com, filling in all the mandatory fields identified there. It is essential that you have an email account to place orders in the online store.

With this registration you will be creating your personal account on the domain www.2cookinn.com, through which you will be able to place orders, monitor your status or carry out operations related to your customer card.

The correct completion of the fields relating to registration is the sole responsibility of the User, and does not bear any costs nor assumes any responsibility arising from error, oversight or omission in filling out the registration fields and/or placing an order and/or resulting from fraudulent purchases made by third parties using User data.

The data entered in the registration is subject to Abecedário’s privacy policy, which can be consulted at www.2cookinn.com. By creating a User registration at www.2cookinn.com you will be declaring that you accept the terms contained in Abecedário’s privacy policy.

The www.2cookinn.com website also allows purchases through the guest purchase functionality. In this type of purchase, the Customer will only be asked for the data essential for processing their order. Once the purchase process has been completed, the Customer will be given the possibility of registering as a user or continuing as an unregistered user.

 

ORDER PROCESSING AND REFUSAL

Once the payment associated with the order has been made, we will arrange for its processing.

Abecedário reserves the right to refuse the order if the information provided when placing the order or creating the User’s personal account is incomplete, the billing information is incorrect, if fraud is suspected and in other cases provided for under these conditions.

In these situations, the User will receive, via the e-mail address associated with their order, information about the cancellation of the order and the reasons for the cancellation.

All orders are subject to confirmation of product availability.

In case of difficulties in supplying products or if the product is out of stock, the User will receive, to the email address associated with their order, information about the temporary or definitive unavailability of the product, with a refund of the amount paid at the time of ordering, within 30 days, counting from the communication of unavailability.

The refund of amounts will be made via bank transfer, and the User must provide the necessary data for this purpose, when contacted. Such refund does not imply any costs for the User.

 

ORDER CANCELLATION BY THE USER

The user may cancel their order by sending, an email to info@2cookinn.com, within 24 hours from placing the order, indicating the reason for cancellation and the order number or attaching/forwarding the email from order confirmation.
Upon receipt of the order by our services, the feasibility or otherwise of canceling the order will be confirmed, under the required terms.

 

ORDERS DELIVERY

The products purchased by the Consumer may come from warehouses in different locations, meaning the order may be received in installments.

Without prejudice to specific situations, products will be delivered within a maximum period of 30 (thirty) days after payment for the order.

For most products, two order delivery methods are available, namely:

Home delivery
This delivery method incurs costs for the User.

The total shipping cost is displayed at checkout after the delivery and transportation method has been selected.
Shipping costs are calculated according to the total weight of the order and destination location, and can be simulated on the shopping cart page.

Delivery times for destinations in mainland Portugal may vary between 7 (seven) and 15 (fifteen) business days after payment of the order.

For deliveries to Madeira, the Azores and other European countries, the User must consult customer service via e-mail info@2cookinn.com.

The User assumes full responsibility for indicating the address of the home where the products must be delivered, as well as the obligation to provide other relevant data for delivery (e.g. homes located on pedestrian streets or with transport circulation schedules, in buildings without elevator or with a small elevator shaft, etc.).

The User will be charged all costs resulting from the need to repeat the delivery act due to the indication of wrong or insufficient addresses or the lack of indication of the existence of situations relevant to the delivery.

Abecedário reserves the right to cancel the order if it is impossible to deliver it to the address indicated for shipping.

The product will be delivered to the User or to the person who, at the time of delivery, presents himself or herself as being in good condition and assumes the obligation to get it to the User.

Collection at 2Cookinn physical stores
This modality does not incur any costs for the User.

The User may, when placing their order, choose from a list of local stores the one where they wish to collect the order.

The User will be notified via email associated with their order that it is available for collection.

To proceed with the collection, you must present your order number at the store’s customer service desk, and you may also be asked for your identification number. Delivery is considered complete after checking and signing by the recipient.

If you wish to collect it from a third party, you must request prior authorization, via email info@2cookinn.com, indicating the name and ID number of the person who will collect the order. When picking up the order by a third party, the third party must display the authorization request made by the Customer.

The User has a maximum period of 15 days to collect the order, counting from the date of sending the email confirming receipt at the selected store.

After the aforementioned period, Abecedário reserves the right to freely cancel the order, being exempt from any responsibility for this fact.

 

CONSUMER’S RIGHT TO FREE RESOLUTION

Consumers have a reflection period of 14 days, counting from the date of delivery of the order, during which they can return the product, without needing to indicate any reason for doing so.

Consumer is understood to be the User who, being a natural person, acts for purposes that do not fall within the scope of their commercial, industrial, artisanal or professional activity.

To exercise the right of free resolution, the following cumulative requirements must be met:

  1. the product must not have been used or tampered with 
  2. the original characteristics of the product must be maintained, which must be accompanied by the original and undamaged packaging; 
  3. the product must be complete and properly packaged in the original packaging;
  4. if the item is made up of more than one piece, they must be returned in full;
  5. inclusion of a copy of the printed invoice.

In order to exercise the right of free resolution, the Consumer must communicate his decision to terminate the contract by means of an unequivocal statement which must include his name, geographic address and contact details, identification of the purchased good, date of request and date of reception of the good.

In this case, you will be sent, without delay, a notice confirming receipt of the resolution.

The Consumer must, without undue delay and at the latest, within 14 days from the date on which he communicated his decision to terminate the contract, send or deliver the ordered product, enclosing a copy of the notice of termination and the invoice purchase, to the following address:

The Consumer will be reimbursed for all payments made, including delivery costs, without undue delay and, in any case, no later than 14 days from the date on which Abecedário is informed of the withdrawal decision.

The additional costs resulting from your choice of a shipping method other than the least expensive standard shipping method offered will be borne in full by the Consumer.

Abecedário may withhold the refund until it has received the returned goods, or until proof of sending the goods is provided, whichever comes first.

The consumer expressly agrees that the refund will be made by bank transfer, without incurring any costs for such transfer.

Alternatively, but respecting the same deadline, the Consumer can make the return at a local physical store – Consult physical stores.

Abecedário does not accept returns of the following products:

1. Food products

2. Food Wraps

3. Hygiene Items (e.g., soap, food wraps, brushes, kitchen towels)

 

RETURN FOR LACK OF CONFORMITY

Abecedário guarantees the compliance of purchased products, in accordance with the provisions of Decree-Law no. 67/2003, of April 8, with the changes introduced by Decree-Law no. 84/2021, of October 18 .

To this end, it will be necessary for the non-conformity of the purchased product to be manifested within a maximum period of 3 (three) years from its delivery, within which in the first 2 years there is a presumption of the existence of the non-conformity of the product on the date of delivery.

After the aforementioned 2 years, the Consumer is responsible for proving that the lack of conformity existed on the date of delivery of the good.

The Consumer must report the lack of conformity to Abecedário, which can be done in person, at any physical store, or via email to be sent to info@2cookinn.com

If the complaint is made via email, Abecedário has the right to demand prior display of the product for the purpose of validating/confirming non-compliance.

If non-compliance is accepted, repair or replacement of the product will be carried out within 30 days, except in particularly complex situations, in which cases the period may be longer.

If it is impossible to repair or replace the product, Abecedário will refund the amount.

Whenever the lack of conformity becomes evident within 30 days after delivery of the product, the Consumer may request its immediate replacement or termination of the contract.

In the case of household appliances, the Customer must deliver the same to the store, accompanied by all the accessories that form an integral part of it, and upon showing the respective proof of purchase.

The Customer will be given a repair note which must be completed accordingly.

2Cookinn has a period of 30 days to carry out the respective repair, except in particularly complex situations, in which case the period may be longer. After this deadline, and if there is no response from the supplier, 2Cookinn will deliver new equipment to the Customer.

 

GUARANTEE

It is essential to show the original proof of purchase for the purpose of activating the warranty.

Defects or malfunctions resulting from inappropriate use of purchased products, failure to follow the instructions/instructions that accompany the products or resulting from repairs carried out by unauthorized third parties are excluded from the scope of the warranty.

To be able to claim the guarantee, the user must contact Customer Service via the email address info@2cookinn.com or go to a physical 2Cookinn store. 

Items purchased by natural or legal persons intended for the development of their commercial, industrial, artisanal or professional activity enjoy a guarantee period of six months, in accordance with the provisions of the Civil Code.

 

PROMOTIONAL CODES (VOUCHERS)

The 2Cookinn voucher consists of a promotional code with a limited validity, assigned by Abecedário and made available through the domain www.2cookinn.com, with a specific value, which can be discounted on purchases made through the online store.

Whenever there is a campaign in force on the website, its specific conditions, such as User eligibility, duration, exclusions, among others, will be duly detailed on the respective campaign page.

Campaigns available online and promotional codes are only valid for purchases on the www.2cookinn.com domain.

 

USE OF THE CUSTOMER CARD

The User may use their customer card, either to accumulate the value of purchases and/or deduct the available balance when paying for orders to be placed, in accordance with the terms and conditions of the Card.

To be able to do so, the User must, before proceeding with their order, associate their card number with their account on the website.

 

CHANGES

Abecedário may, at any time and without prior notice, modify these conditions or introduce new conditions by publishing them on the domain www.2cookinn.com.

EXCLUSION OF WARRANTIES AND LIABILITY

The obligations will be suspended during the period in which the “cause of force majeure” persists, with Abecedário providing an extension of the period to fulfill the aforementioned obligations for a period of time equal to the duration of the “cause of force majeure”, without there is room for payment, by Abecedário, of any compensation, compensation or any other amount, for whatever reason, taking all reasonable legal means within its reach to put an end to the “cause of force majeure”, or that allows it to find a solution that makes it possible to fulfill your obligations.

 

INTELLECTUAL PROPERTY
